Idle spouse can’t burden partner with maintenance liability: Delhi HC

The Delhi High Court has ruled that a spouse who is capable of earning but chooses to remain unemployed cannot burden the other partner with maintenance liability. The court reduced the monthly maintenance amount from Rs 30,000 to Rs 21,000 to be paid by a man to his estranged wife under the Hindu Marriage Act. The court emphasized that maintenance should be provided to the spouse who is unable to support themselves and that both husband and wife's rights and obligations should be examined.
