For accused's personal liberty, court opts to accept charas was not of commercial amount

Justice M S Karnik granted bail to an accused in a drug case, considering the weight of the seized contraband as an intermediate quantity, not commercial. The accused, Nayak, had been caught with 1kg of charas, which falls under the category of cannabis in the NDPS Act. The high court clarified that it expressed no opinion on merits but granted bail based on the weight measured before the court. The court also mentioned that there was no evidence of joint involvement or connivance between Nayak and the other accused.
