House arrest curtails liberty, must be part of total custody period: Bombay HC

IndiaTimes Saturday, 9 December 2023
The Bombay High Court released hawala operator Mohamed Farooq Shaikh on bail, stating that house arrest curtails a person's liberty. The court disagreed with the Enforcement Directorate's argument that the period of house arrest should not be considered in calculating Shaikh's custody. Shaikh has been in custody for over five years and eight months for a money laundering scam. The court noted that he has already completed three-fourths of the prescribed sentence and directed his release on a personal bond.
