Biggest transfer since Emergency shows power shift to judiciary: HC judge

IndiaTimes Tuesday, 21 November 2023
An outgoing judge from the Calcutta High Court has compared the recent transfer of judges between high courts by the Supreme Court collegium to the transfers that took place during the Emergency in 1975. The judge believes that this transfer of power from the executive to the judiciary indicates a significant shift. He also called for a re-examination of Article 222, which deals with the transfer of judges. The judge had appealed to the collegium to reconsider his own transfer but his request was turned down.
