HC allows rape survivor, 17, to have MTP but says must file affidavit she won't turn hostile

MP HC has allowed medical termination of pregnancy (MTP) of a 17-year-old rape survivor but on condition that the girl and her father file an affidavit that they will not change their statement during the trial. In a recent order, Justice Ahluwalia asked trial court to report to the HC registrar general if the girl turns hostile or claims that the accused did not rape her or that she is an adult. The court noted that the girl and the accused knew each other but her consent to a physical relationship is not relevant since she is a minor.
