Police nor criminal court can seize passport, says Karnataka HC
The High Court of Karnataka reiterated that neither the police nor the criminal court can seize or impound a passport under Sections 102 or 104 of the Criminal Procedure Code. The court quashed the order of the Debt Recovery Tribunal-1, Bengaluru, which impounded the passport of Mumbai businessman Nitin Shambhukumar Kasliwal. The court stated that the Tribunal, being a civil court, does not have the power to impound passports, as the Passport Act prevails over the powers of the civil or criminal court.
