Sgt.

Jesse Franklin, the Hamilton County deputy charged with assault and accused of kicking an inmate in the head June 9, was disciplined 12 years ago for "unnecessary use of force" on another inmate in the county jail, according to records in Franklin's personnel file.

Whilecorrections officers held theinmate on the floor, jailvideo appears to show Sgt.Jesse Franklin kicked him inthe head.THESE ACTIONS ARE INCONSISTENTWITH OUR TRAINING AND WILL NOTBE TOLERATED UNDER MY WATCH.Sheriff Jim Neil said hesuspended Franklin without payon June 18th and took away hispolicing powers.

Franklin'spersonnel file, obtainedThursday by the WCPO 9 I-Team,shows Franklin received acounseling letter in 2008 for"unnecessary use-of-force" onan inmate.

According to thereport on the incident,Franklin said the inmatethreatened him from inside hiscell.

Franklin said he saw theinmate get up on his bed andfeared for the inmate'ssafety, so Franklin asked acorrections officer to openthe inmate's cell door.Franklin claimed the inmateran toward him and swung atFranklin.

Franklin said hepushed the inmate.

Franklinhit a wall.

A correctionsofficer separated Franklin andthe prisoner.

Franklin wastaken to a hospital fortreatment.

That was the onlyprevious discipline Franklinreceived for a use-of-forceincident.

In November 2019,Franklin received his mostrecent annual employeeevaluation - receiving anoverall score of 11 on a scaleof 1-20.

The supervisor whoevaluated his performancewrote "Sgt.

Franklin does agood job of handling day today operations in intake" buthe" struggles with making sureuse-of-force reports areturned in in a timely manner."A Hamilton County grand juryindicted Franklin formisdemeanor assault in theJune 9th incident.

Ifconvicted, he faces up to 6months in jailCraig CheathamWCPO 9 I-Team.
