Post-Adarsh Circular for Defence NOC confers no right to stop ongoing, already made constructions: HC

The Bombay High Court has ruled that the defense ministry's no objection certificate (NOC) was not required for construction near a military establishment in Pune. The court stated that the circulars issued by the ministry did not confer any right to prohibit ongoing construction or demolition of existing buildings. The court dismissed a petition filed by the Center against the permissions granted by the Pune Municipal Corporation in 2008. The court also directed the PMC to issue the Occupancy Certificate for the building within eight weeks.
