Parliament dissolution a political issue, SC should dismiss case: Nepal PM

Calling the Nepal government's move to dissolve the lower house of the Parliament to be a 'political move', Prime Minister KP Sharma Oli said the Supreme Court should dismiss the case.

Oli's comments come as the move, which has been claimed to be unconstitutional by members of the ruling party and the opposition, is being challenged in the apex court, where hearings are currently underway.

A total of 13 petitions are filed in the Supreme Court of Nepal, challenging the decision of Oli and President Bidhya Devi Bhandari to dissolve the House of Representatives, the lower house parliament, claiming it unconstitutional.

The apex court has yet to give a verdict on the writ petitions.

Following the dissolution of the Lower House and the announcement of midterm elections, the ruling Nepal Communist Party (NCP) witnessed its vertical split as the already-strained ties between the two rival factions of the party have further deepened.

The Oli-led faction of the ruling party is backing the dissolution of the House while the other faction led by Pushpa Kamal Dahal and Madhav Kumar Nepal is firmly opposing the government's move and demanding the restoration of parliament.

The government's talks team chief Ram Bahadur Thapa and CPN's talks team head Khadga Bahadur Bishwakarma 'Prakanda' formally inked the deal on the occasion in the presence of Prime Minister KP Sharma Oli, CPN General Secretary Chand and cabinet ministers, among others. CPN (Maoist) had split from the Maoist Communist Party which fought government troops between 1996 and 2006 when it gave up its armed revolt and entered mainstream politics.

Several protestors were injured on Thursday in Kathmandu as resistance against the dissolution of parliament continued to intensify in the Himalayan Nation. Cadres and members of the student union of a rival faction of the ruling Nepal Communist Party clashed with police near the parliament in a bid to enter the restricted area which left several injured. The protest against the "unconstitutional move of Oli to dissolve parliament" on Thursday intensified with the arrest of a female leader Ram Kumari Jhakri from her house. She was arrested in line with Clause 58 of the National Penal (Code) Act, 2017 related to the Prohibition of Intimidation of the President or Parliament. Jhakri while addressing a mass meeting in recent weeks in Gorkha had made comments over President Bhandari which led to the arrest of the leader. According to Clause 58 (2), the person who commits, or causes the offence to be committed, could be jailed up to seven years or fined up to Rs 70,000, or both. Protestors raised slogans against Oli demanding his resignation along with the Home Minister for not being able to maintain peace and stability in the society. Kathmandu has been marred by anti-government protests on a daily basis which has been growing significantly over the period of time starting from December 20 when now caretaker Prime Minister KP Sharma Oli dissolved the parliament.

Oli's visit to the election commission comes after a meeting of Council of Ministers decided to hold the first phase of the mid-term elections in 40 districts of Province 2 and Gandaki, Karnali, and Lumbini provinces on April 30 and in 37 districts of Bagmati, Sudurpaschim and Province 1 on May 10 in the second phase. Elected after a landslide victory in the 2017 elections, KP Sharma Oli from the ruling Nepal Communist Party (NCP) became the first Prime Minister of the Federal Republic of Nepal. The NCP was formed after the amalgamation of two communist parties in the Himalayan Nation, but it is headed for a split after more than two years. A faction under the leadership of former Prime Ministers Pushpa Kamal Dahal and Madhav Kumar Nepal has practically broken off from the Oli alliance but has been denied recognition from the Electoral Body.
