Can't deny maintenance to 'second wife', says Bombay high court

IndiaTimes Sunday, 17 December 2023
The Bombay High Court has ruled that a man who remarried while still legally married to his first wife cannot deny maintenance to his second wife. The court upheld a previous order for a monthly maintenance amount of Rs 2,500 and allowed the woman to file for an increase. The court considered the second woman as the 'wife' under Section 125 of the Criminal Procedure Code, which provides for maintenance to wives who are unable to support themselves.
